These Terms and Conditions govern your use of the website wonderandwhimsy.com.au, and the booking and participation in sessions operated by Wonder and Whimsy Tamborine Mountain, ABN: 29 140 659 867 of Tamborine Mountain, Queensland, Australia.

By accessing the Website, making a booking, or allowing a child to participate in our sessions, you agree to be bound by these Terms.

1. Services

We provide supervised creative sessions for children aged 3 to 12 years. Session details, schedules, and pricing are listed on the 

Website and may be updated from time to time.

2. Eligibility and Parental Responsibility

Bookings must be made by a parent or legal guardian aged 18 years or older.

By booking a Session, you confirm that you are the parent or legal guardian of the participating child.

You are responsible for ensuring that the information you provide (including medical or allergy information) is accurate and complete.

You remain responsible for the child’s behaviour and compliance with these Terms.

 

3. Bookings and Payments

All bookings are subject to availability.

Payment must be made at the time of booking unless otherwise stated.

Payments are processed securely through third-party provider,  Squareup.

A booking is only confirmed once depsoit has been successfully received and a confirmation has been issued.

We reserve the right to refuse or cancel bookings at our discretion (for example, due to capacity limits or safety concerns).

 

4. Pricing

All prices are listed in Australian Dollars (AUD) and include GST where applicable.

We reserve the right to change pricing at any time, but changes will not affect confirmed bookings.

 

5. Cancellations and Refunds

Cancellations by you:

No refunds of deposits will be provided for change of mind or late notice cancellations.

Transference of deposits to a new date or session is up to the discretion of Wonder and Whimsy Tamborine Mountain.

No-shows:

No refunds or credits will be provided for missed sessions without notice.

Cancellations by us:

We may cancel or reschedule Sessions due to unforeseen circumstances (e.g. illness, low enrolment, venue issues).

In such cases, we will offer a reschedule or full refund.

 

6. Health, Safety, and Conduct

You must inform us of any medical conditions, current sicknesses, allergies, or behavioural considerations relevant to the child’s participation.

We reserve the right to refuse participation if we believe it may pose a safety risk.

Children must follow reasonable instructions from staff at all times.

We may remove a child from a Session if their behaviour is unsafe or disruptive. Refunds in such cases are at our discretion.

 

7. Assumption of Risk

While we take reasonable care to provide a safe environment, art and craft activities may involve inherent risks (e.g. use of tools, materials, or minor accidents).

By enrolling your child, you acknowledge and accept these risks.

 

8. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for any injury, loss, or damage arising from participation in Sessions, except where caused by our negligence or as required under the Competition and Consumer Act 2010 (Cth) or other applicable laws.

Our liability, where it cannot be excluded, is limited to the resupply of the Session or refund of the amount paid.

Nothing in these Terms excludes rights you may have under Australian Consumer Law.

 

9. Collection of Children

Children must be collected promptly at the end of each Session by a parent, guardian, or authorised person.

You must notify us in advance if someone else will collect your child.

Identification may be required.

Late collection may incur additional fees.

 

10. Photos and Media

We will not take or use photographs or videos of children for promotional or marketing purposes without prior written consent from a parent or guardian.

 

11. Website Use

You agree to use the Website only for lawful purposes and must not:

Misuse or interfere with the Website

Attempt unauthorised access to systems or data

Submit false or misleading information

We do not guarantee that the Website will always be available or error-free.

 

12. Intellectual Property

All content on the Website, including text, images, branding, and materials, is owned by or licensed to us.

You must not reproduce, distribute, or use any content without our prior written consent.

 

13. Privacy

Your use of the Website and our services is also governed by our Privacy Policy.

By making a booking or allowing your child to participate in our Sessions, you confirm that you have read, understood, and agree to these Terms and Conditions.
